Workers’ Compensation Case Results

Our client worked for a service company for 27 years before sustaining a cervical disc herniation. After his first surgery, he returned to full-duty work in under 60 days. Two years later, he suffered another cervical disc herniation, requiring a second and third surgery—neither of which restored his ability to return to full-duty work.

He was only able to perform desk work for 2 hours per day, 3 days per week, and received Temporary Partial Disability (TPD) payments until he reached the maximum number of payable weeks. When the carrier cut off his payments, our firm filed for Permanent Total Disability (PTD).

After a full appeal before the Compensation Appeals Board, we secured what is believed to be New Hampshire’s first-ever PTD award for an employee who continued to perform some paid work at his original place of employment.
